Gardener Downham offers a comprehensive range of gardening services, including but not limited to:

Lawn Maintenance: Mowing, fertilizing, and aerating lawns to keep them healthy and vibrant.
Garden Design: Creating aesthetically pleasing and functional garden layouts tailored to client preferences.
Planting Services: Selecting and planting a variety of flowers, shrubs, and trees to enhance garden beauty.
Weed Control: Eliminating unwanted plants and maintaining garden health through effective weed management.
Seasonal Clean-Up: Preparing gardens for different seasons by removing debris, pruning plants, and protecting against seasonal changes.

Service Terms

All services will be provided in a professional and timely manner. Gardener Downham reserves the right to adjust service schedules to accommodate unforeseen circumstances, such as extreme weather conditions or equipment malfunctions.

Payment Terms

Clients are expected to pay for services rendered upon completion. We accept various payment methods, including cash, credit cards, and electronic transfers. Invoices will be issued detailing the services provided, costs involved, and the payment due date. Late payments may incur additional fees as stipulated in our policy.

Cancellation and Refund Policy

Clients may cancel scheduled services by providing at least 48 hours' notice. Cancellations made within this timeframe will not incur any charges. However, cancellations made with less than 48 hours' notice may result in a cancellation fee equivalent to 50% of the scheduled service cost. Refunds for any prepaid services will be processed within 14 business days, subject to our refund policy.

Client Obligations

Clients are responsible for ensuring that the garden area is accessible and free from obstructions on scheduled service days. It is also the client's responsibility to communicate any specific requests or concerns regarding the services to Gardener Downham in advance.

Limitation of Liability

Gardener Downham strives to provide excellent services; however, we cannot be held liable for any unintentional damage to property or plants unless caused by gross negligence or intentional misconduct. Clients are encouraged to discuss any particular concerns they may have to mitigate potential risks.

Intellectual Property

All content provided by Gardener Downham, including but not limited to designs, images, and written materials, is the property of Gardener Downham and is protected by intellectual property laws. Unauthorized use or reproduction of this content is strictly prohibited.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Downham operates. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in this area.

Changes to Terms

Gardener Downham reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes through official communication channels. Continued use of our services after such modifications constitutes acceptance of the new terms.

Privacy Policy

Your privacy is important to us. Gardener Downham is committed to protecting your personal information and will only use it in accordance with our Privacy Policy. We do not share your information with third parties without your consent, except as required by law.

Termination

Either party may terminate the service agreement by providing written notice. Upon termination, any outstanding payments for services rendered will become immediately due. Termination of services does not waive any rights or remedies previously accrued by either party.

Force Majeure

Gardener Downham will not be liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, or government restrictions. In such events, we will communicate with clients to reschedule services as soon as possible.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms and Conditions constitute the entire agreement between Gardener Downham and the client regarding the usage of our services, superseding all prior agreements and understandings.

By availing the services of Gardener Downham, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
